TERMS & CONDITIONS
In the following terms & conditions “the photographer” shall mean to us trading as Triberry Studios. These terms &
conditions cannot be varied in any way by the clients unless such conditions are expressly agreed by the Studio in
writing.
1. COPYRIGHT
The copyright Designs and Patents Acts assign the copyright of the images & Videos to the Studios itself.
2. DISPLAY
The client hereby allows the photographer to display any phoatograph or Video covered by this contract and to
generally promote the business in advertising, social media, brochures, magazine articles, websites, sample albums
etc.
3. PAYMENT
Client agrees to pay as per the selected(by client) payment module (only one) for their assignment signed between
him and The Studio.
Payment modules are as below:
1.One time complete payment (atleast 15 days before the date of the Event/Shoot)
2.Part Payments (50%-50%)
The Client shall make a booking fee ( Atleast 50% of the estimate ) as per contract to retain the Studio to perform the
services specified in the contract.
The Balance payment is to be made on the day of the event itself. No Outstanding payments will be encouraged.
4. Cancellation
If the Client shall cancel this Agreement more than six (6) calendar days before the photo shooting day, any booking
fee paid to the Photographer shall be refunded in full if the Photographer is able to re-book the same date. If the
Photographer is NOT able to secure another client for the date, or if the cancellation occurs less than six (6) calendar
days before the portrait date, the Client forfeits the booking fee.
5. FORCE MAJEURE
i. In the very unlikely events of cancellation by the photographer or of total photographic failure, liability shall be
limited to a full refund of any fees paid.
ii. The photographer will endeavour to put the client(s) in touch with another photographer in the event they are
unable to attend on the wedding date due to any cause beyond their reasonable control e.g. sudden illness, injury,
victim of crime, flooding, traffic conditions, vehicle breakdown etc.
iii.Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is
available, the photographer will not be responsible for photographs that are not produced due to technical failure.
6. ARCHIVING DIGITAL FILES
While Photographer may choose to archive the Image(s), it is the Client’s responsibility to properly store and archive
the Image(s) for the duration of the term of the license. Photographer cannot guarantee the availability of any
Image(s) beyond the date of first delivery to Client.
If the Client requests copies of previous work from Photographer’s archives there will be a ten percent (10%) fee for
furnishing them to Client. If no archive exists the photographer will not be held liable.
7. GENERAL TERMS
Raw images will not be shared.
Triberry Studios keeps client files for up to 6 Months after the photography session, and is not liable for any claims after
this period. All client files will be deleted and backups will be purged after this period.
Client accepts that all photographs will be taken and edited at the photographer’s discretion based on the photographer’s
experience and artistic view. If the client has special requests shall create a “shot list” of all shots that they require.
It is also understood that unless hair and makeup is included in the contract, Photographer is not responsible to fix hair
or skin, or makeup problems.
Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons
own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.
It’s a digital day age; we capture everything in digital media. If any data gets
corrupt due to any loopholes of digital media, then we are not responsible for it.
The photographer is committed to using high-quality products. However, Client is aware that colour dyes, toners, inks,
and other materials, used in photography may fade or discolour over time. As such, Client releases Photographer and his
assigns, contractors, and representatives, from any liability for any claims, damages, or costs, arising from any fading or
discolouration of any photographic prints.
Direct & indirect cost pertaining to shoot shall be borne by clients. Example Props charges, Transportation charges,
Lodging etc. are to be borne by client.
Triberry Studios is not liable for any damage casued to the Album once the delivery is made. This includes physical
damage to the album, water damage & Misconduct.
For Outdoor location shoot: Travel, Stay, Food, Ticket Expense of entire unit has to be taken care by the client.
8. DELIVERY
i.The Studio will endeavour to deliver digital files as quickly as possible. However, this could take up to 6-8 weeks during
busy periods.
ii.The Studio will endeavour to deliver the Video Output as quickly as possible. However, this could take up to 8-12 weeks
during busy periods.
iii.The Studio will endeavour to deliver the Album as quickly as possible. However, this could take up to 8-14 weeks after
the selected photos are given to the photographer.
iv.Once the final delivery is confirmed and completed, No extra requirements will be served without payment.
9.ACCEPTANCE OF TERMS
i.A client may not assign or transfer this Agreement or any rights granted under it. This Agreement binds Client and inures
to the benefit of The Photographer, as well as their respective principals, employees, agents, affiliates, heirs, legal
representatives, successors, and assigns. Client and its principals, employees, agents, and affiliates, are jointly and
severally liable for the performance of all payments and other obligations hereunder.
ii.No variation of terms and conditions set out herein shall be effective unless agreed in writing by both parties.
